Spacethetic Terms of Service

1. Service Availability and Quality

We are constantly improving the Services. The Services are subject to modification and change, including but not limited to the algorithms used to generate Assets, visual styles, and features available to you.

No guarantees are made regarding the Services' quality, stability, uptime, or reliability. Please do not create business or personal dependencies on specific features or outputs of the Services.

Both the Services and the Assets are provided to You on an "AS IS" basis, without warranties of any kind, express or implied, including without limitation warranties of title, non-infringement, merchantability, or fitness for a particular purpose.

You are solely responsible for determining whether use of the Services or the Assets is appropriate for your purposes and assume any risks associated with that use.

We reserve the right to suspend or terminate your access to the Services at any time and for any reason. You may not reverse engineer, resell, redistribute, or use the Services to build a competing product. Each registered account may only be used by a single individual.

2. Age Requirements

By accessing the Services, You confirm that You are at least 13 years old and meet the minimum age of digital consent in Your country. If You are old enough to access the Services in Your country but not old enough to consent legally to these Terms, a parent or guardian must agree on your behalf.

If you are a parent or guardian, and you allow your teenager to use the Services, then these Terms also apply to you, and you are responsible for their activity.

3. User Content and Responsibility

You are fully and solely responsible for all Content you upload or generate using Spacethetic.

This includes:

• Ensuring you have the rights, permissions, and authority to upload images, designs, furniture models, or other materials.
• Ensuring uploaded or generated Content does not infringe on any third-party intellectual property, publicity, or privacy rights.
• Ensuring your use complies with applicable laws and these Terms.

Tandav Labs assumes no liability for:

• Disputes arising from images you upload (including but not limited to photos of your home, third-party furniture, branded products, or copyrighted design elements).
• Claims relating to generated Assets (including likenesses, design variations, or representations of third-party objects).
• Any legal or regulatory proceedings connected to your Content or use of the Services.

If you upload or generate Content, you warrant that you are legally entitled to do so and accept full responsibility for the results.

4. Content Rights

Your Rights: You own the Assets you create with the Services to the fullest extent permitted by law, subject to these Terms and third-party rights.

Our Rights: By using the Services, you grant Tandav Labs a worldwide, non-exclusive, royalty-free license to use your Content for operating, maintaining, and improving the Services. This may include processing and storing your uploads, generating design outputs, and enabling platform features.

5. Intellectual Property and Restrictions

You may not:

• Upload or generate Content that infringes on others' intellectual property rights.
• Use the Services to create misleading, defamatory, fraudulent, or unlawful Content.
• Upload or generate Content depicting individuals without their consent.
• Attempt to use Spacethetic for illegal purposes or in ways that violate these Terms.

6. Limitation of Liability

You acknowledge and agree that:

• Tandav Labs is not responsible for your Content. You bear sole responsibility and liability for all Inputs and Assets.
• We are not liable for any incidental, indirect, or consequential damages, including loss of profits, goodwill, or data, however caused.
• Our aggregate liability will not exceed the fees you paid for Services in the 12 months before the claim.

7. Indemnification

You agree to indemnify and hold harmless Tandav Labs, its affiliates, and its employees from any claims, losses, liabilities, damages, costs, and expenses (including attorneys' fees) arising out of:

• Your use of the Services or Assets,
• Your violation of these Terms,
• Any claim that Content you uploaded or generated violates the rights of a third party.

8. Dispute Resolution and Governing Law

Any disputes arising from these Terms will be resolved by binding arbitration in Santa Clara County, California, USA, under the American Arbitration Association's rules. You waive your right to a jury trial.

This Agreement is governed by the laws of the State of California, USA, without regard to conflict of law rules.

9. Miscellaneous

Force Majeure: Neither party is liable for delays caused by events beyond their reasonable control.

No Third-Party Rights: These Terms do not confer rights on any third party.

Severability: If part of this Agreement is invalid, the rest remains enforceable.

Survival: Sections relating to liability, indemnification, and Content rights survive termination of this Agreement.
